Determinations

Council may determine whether or not a person contravened a provision of the Private Managed Forest Land Act or the regulations. The Compliance Determinations Procedure Manual describes the process that the Council follows for making a determination.

The Private Managed Forest Land Council has determined that Port Alberni owner contravened section 31 of the Private Managed Forest Land Council Regulation 2007 by failing to ensure that a portion of a cutblock harvested in 2002 was adequately restocked.

The Private Managed Forest Land Council has determined that Galiano Island owners contravened section 31 of the Private Managed Forest Land Council Regulation 2007 by failing to ensure that a portion of a cutblock harvested in 2001 was adequately restocked.

Update August 2010: Council is satisfied that the requirements of the remediation order have been met. The owner has carried out a planting project to high standards and successful regeneration of the property is anticipated.

The Private Managed Forest Land Council determined that TimberWest Forest Corp contravened section 18 of the Private Managed Forest Land Council Regulation by failing to retain at least 20 trees along each 100 m of the east side of Beech Creek that is adjacent to Block CW500. This determination has been rescinded and therefore has no effect.
