Reconsiderations

A reconsideration of a compliance decision made by the Council or a stop work order issued by a person authorized by the Council can be initiated by the Council or on the request of the person who is the subject of the original decision. The Council has no jurisdiction to reconsider a decision if it is already subject to an appeal that has concluded. Reconsiderations are conducted in accordance with the Compliance Determinations Procedure Manual.

On November 3, 2007 TimberWest requested that the Council, under section 32 of the Private Managed Forest Land Act, reconsider its determination of 27 September 2007 and provided written submissions in support of its request. The Council determined in March 2008 that TimberWest exercised due diligence in respect of the events within Block CW500 and as a result of the due diligence, TimberWest cannot be found to have contravened the regulation. For this reason, the Council rescinded the original determination.
